Checkers Drive-In Restaurants, Inc. (Nasdaq: CHKR) today announced that Ronald B. Maggard, a Director of the Company since August of 1999,
has been elected Chairman of the Board of Directors effective immediately. Mr. William P. Foley, II
is stepping down to greater focus his attentions as Chairman of the Board and Chief Executive
Officer to operations at Fidelity National Financial, Inc. and its subsidiaries and as Chairman of the
Board at CKE Restaurants, Inc. Mr. Foley, Mr. Maggard’s predecessor, will continue to serve as a
Director of the Company.

In addition to his duties at Checkers, Mr. Maggard is currently President of Maggard Enterprises of
Newport Beach, California, which owns and operates 20 franchised Long John Silver’s
Restaurants and is a Director of Santa Barbara Restaurant Group, Inc.

William Foley, outgoing Chairman of the Board, commented: “Checkers has come a long way
since I became Chairman in 1997, the Company has returned itself to profitability and stability
through the fine efforts of Dan Dorsch and the managerial team he’s put in place. The revitalization
of Checkers and Rally’s secured, it is now the time for me to shift my personal focus on to other
enterprises.”

Ronald Maggard, newly elected Chairman of the Board, commented: “I am looking forward to
